TOWNSHIP COUNCIL PUBLIC MEETING MINUTES
- October 13, 2009
The Public Meeting of the Mount Olive Township Council was called
to Order at 8:14 pm by President Rattner with the Pledge of Allegiance.
OPEN PUBLIC MEETINGS ACT ANNOUNCEMENT
According to the Open Public Meetings Act, adequate notice of this
meeting has been given to the Mount Olive Chronicle. Notice has
been posted at the Municipal Building, 204 Flanders-Drakestown
Road, Mount Olive Township, New Jersey and notices were sent to
those requesting the same.

President Rattner: Okay, at this point does anybody have any questions
on the Bill List? The Bill List presenter has a question.
Mrs. Maniscalco: No, actually I just have a comment. When Colleen
ran the Bill List, she ran it from 9/29 which was the last Bill
List date, and obviously you already approved all of that while
I was on vacation. So the Bill List date should have gone from
9/30 to today’s date. So just an F.Y.I. that all the 9/29
payments that are on here you already approved, okay, and I don’t
have those vouchers with me again. So if anybody has a question
for something you already approved then I’ll have to get
back to you. Got it?
President Rattner: So this is actually four weeks worth of vouchers
on the List?
Mrs. Maniscalco: This is, well, it’s going from 9/29, Steve,
which was the last Bill List date to 10/13. She should have ran
it from 9/30. It’s got more information than it needs to
but it’s not like anything is missing. So just an F.Y.I.
President Rattner: Oh, okay, one day, and we have your word you
won’t pay them twice.
Mrs. Maniscalco: Yes, exactly. Okay?
President Rattner: Mr. Russell, do you have any questions?
APPROVAL OF MINUTES OF PREVIOUS MEETINGS
President Rattner: Okay, moving right along. Approval of Minutes
of Previous Meetings. Mr. Mania, do you want to move September
29th?
Mr. Mania: I move for the approval of:

President Rattner: Does anybody have any comments or corrections?

President Rattner: And I hear one abstention.
Mrs. Labow: Can we backtrack to the Bill List for a second?
President Rattner: No.
Mrs. Labow: Please.
President Rattner: What was the question on the Bill List?
Mrs. Labow: Well, actually, Sherry’s going to have to find
out because it’s from 9/29. I missed it the last time.
Mrs. Maniscalco: I was gone too, so go ahead. What do you got?
President Rattner: Well, she doesn’t have it for tonight.
Mrs. Labow: On page 6, the Musco Lighting, $2,400 to adjust the
lights.
Mr. Roman: Yes.
Mrs. Maniscalco: Actually, Tim or Jim probably can answer that.
Mrs. Labow: We don’t have any kind of maintenance or anything
like that with them, or is this something special that they had
to do?
President Rattner: I think this was fine tuning the direction.
Mrs. Maniscalco: This was the Flanders Park lights.
Mr. Lynch: The Musco bill was an adjustment. There was nothing
under our service contract that was wrong with the lights. This
was an impact on a resident in Flanders Crossing that we had to
adjust all of the fixtures on one of the towers.
Mrs. Labow: Okay.
Mr. Lynch: So that’s an extraneous cost to our 25 year warranty.
President Rattner: Mr. Roman?
Mr. Roman: Now, was that lighting aimed improperly to begin with?
Mr. Lynch: No, it fell within the scope of the engineering that
Musco originally did. However, Musco does not engineer for a linear
half mile out from the facility. So this was brought to our attention
after it was done and it was rectified so that the resident was
no longer impacted.
Mr. Roman: I tried to offer him sunglasses but he wouldn’t
take it.
President Rattner: Is the resident satisfied?
Mr. Lynch: We did meet down there. It was myself, Mr. Masotti,
Mr. Shakespeare and the resident. All parties left the facility
agreeing that everything was now where it needed to be. We are
asking, Musco has the light value readings from the readjusted
light pole. They are doing a check on those to make sure they still
meet specifications and no one is jeopardized on the field.
President Rattner: Mr. Greenbaum?
Mr. Greenbaum: You know, I actually had an opportunity to go to
that particular homeowner’s residence to see what the situation
was because that house is quite a distance from the field. That
light, that one particular light was directly into the house. I
mean, to the point of where you couldn’t sit on the porch
and it seems odd to me that fell within the guidelines of what
was permitted when the light was installed. I’m a little
troubled by the fact that Musco is charging us that much money
to adjust that light. I understand that they probably had to bring
in equipment to get up to the top of the light to do it but that
light, in my mind, was never properly set and was problematic from
the get go. I’m not sure that there’s anything that
we can do about it at this point.
President Rattner: Yes, well, the department thinks that it was,
you know, they were within the limits. I assumed it was fine tuning.
Mr. Lynch: Unfortunately, I mean, I’m not an expert in that
area. They said it met specifications when it was installed and
I don’t know that I have an arguable point against it.
President Rattner: Okay.
Mr. Lynch: I did see it. I agree with Mr. Greenbaum. However,
I feel bad because the resident did send pictures. If he had taken
the pictures from the opposite direction, the pictures he sent,
okay, there might be an issue. When I got there and actually looked
from the back of the house it was like full sunlight at noon. It
was pretty…
Mr. Greenbaum: That light was just clearly off.
President Rattner: Well maybe if Colleen realized it two weeks
ago we wouldn’t have paid the bill.
Mrs. Labow: Yes, I missed it darn it. It’s all my fault.
President Rattner: It’s already gone. Thank you, Jim.
Mr. Perkins: So you mean we’ve been providing them with
protective light services?
Mr. Mania: Excuse me, Mr. President. Can’t we show the contractor
the pictures of that house and maybe negotiate what kind of monies
he’s asking for? Maybe just pay him for his equipment or
something?
Mr. Greenbaum: It’s already been paid.
President Rattner: I think he got paid two weeks ago. That was
the issue. Oh, no, that’s why I was saying if it came up
two weeks ago maybe we could have done that.
Mr. Greenbaum: Well, the contractor was aware. I’m sure
that contractor was quite aware of how that light was affecting
that one particular house. It’s really odd because that house
is not one of the houses along the road. It’s far setback.
President Rattner: Well, you know, I remember one. I think Bill
will remember this. Years ago when we had the asphalt operation
on Goldmine Road, they built a berm to try to get down the noise
and where the noise was loudest, the loudest measurable noise,
was on Indian Spring Road.
Mr. Sohl: Yes.
President Rattner: You remember whose house it was too. It was
legitimate. Who would think that you do everything you have to
and a couple miles away…
Mr. Sohl: And yet it was within spec, I believe, in terms of the
Noise Ordinance.
President Rattner: Yes, okay. Thank you, Jim.

Mrs. Labow: Just on the removal of number twelve, we also have
to remove that from the Bill List. Sherry, page 14?
Mr. Roman: There’s a refund to Michael Calaremi.
Mrs. Labow: Is that the same that the resolution is for?
President Rattner: Wait a minute. How much, no…
Mrs. Labow: That’s what I’m trying to find out.
President Rattner: That dealership has three lots. I think what
you see that’s on there are a vacant lot which doesn’t
have any utility now because it’s in the Highlands, and I
forget where the other one is. It was three lots and those are
two other ones.
Mrs. Labow: So it’s not the same one we’re taking
off?
Mrs. Maniscalco: Let me also explain. When you actually approve
the resolution, it takes one month, two months, sometimes three
months to actually get a settlement. It’s only until then,
once we get a final settlement from the court, that we will actually
make any kind of an adjustment. So this one, Colleen, was for a
settlement as Steve said for the same owner, different property,
for a settlement we’ve already gotten in hand.

Mr. Sohl: Yes, just one item. I’d just like to mention a
copy of a letter that was sent from the Department of Agriculture
to our Health Department, Frank Wilpert, indicating that the Department
of Agriculture is pleased to report that no major infestations
were detected for the Gypsy moth. So we’re not in line for
any spraying. A copy of this letter was provided to the Clerk’s
office on Friday afternoon.
President Rattner: Mr. Greenbaum and then Mr. Perkins.
Mr. Greenbaum: What’s going on with flu shots in the Town,
do you know?
Mr. Sohl: We’re out of flu shots.
Mr. Greenbaum: We’re out of them?
President Rattner: The standard flu shot.
Mr. Greenbaum: Right.
Mr. Sohl: Standard, right. We did not have the H1N1 yet.
Mr. Greenbaum: Do you know about that, Ray?
President Rattner: Mr. Perkins?
Mr. Perkins: Yes.
President Rattner: You’re up.
Mr. Perkins: We’re actually not out of them. We’re
out of them to offer to Mount Olive Township at this point.
Mr. Sohl: For the moment we are, yes.
Mr. Perkins: We still have to meet our contractual obligation
with our shared service communities, but for all intents and purposes,
Mount Olive Township has depleted the 1,000 flu shots that we had
and we are still waiting to see what type of the H1N1 vaccination
we are going to....
President Rattner: For Mr. Greenbaum and anybody that’s
here inside, insight into it that Mount Arlington’s flu shot
clinic is this Friday. If they are not all used up it does come
back here and then they could be available.

Mr. Roman: As I stated earlier, Soccer put on their presentation.
There were a lot of what I’d like to consider pointed questions
I would have asked of Soccer, and a lot of things were aired out.
I think one of the things that seemed pleasing that I think some
of the other organizations kind of came into the meeting feeling
a little animosity towards Soccer, but at the end a little kumbaya
feeling was felt by all.

Mr. Perkins: Yes, Mr. President. I was unable to attend the last
meeting but Mr. Mania was there. So I would ask that he give a
quick report.
Mr. Mania: Yes, the meeting was held in Long Valley attended by
representatives of various towns. A lot of questions were asked.
I particularly asked about Mount Olive being in the Preservation

been on top of and it covers such a small part. It doesn’t
cover the School taxes and something else. I think we get a total
of $53,000 for all of our losses and that’s not the loss
in value of different developers and other business owners and

we were putting a fence for the Beach, put up fencing in the back.
So the surveying was started this week and I have discovered that
I owe the Township like ten feet of property.
Mayor Scapicchio: That’s why we’re putting the fence
up. We want all our property from everybody over there.
Mrs. Labow: Where’s the funding for that fence coming from?

President Rattner: What part of your operation does the Town get?
Is it enough to service trucks?

Mayor Scapicchio: The fence didn’t go up yet, Alex.
Mr. Roman: No, no, the surveying, they started surveying and digging
holes in there. I thought somebody was vandalizing the place. They
informed me that, uh oh, you’ve got to move a couple of cars.

Mrs. Labow: Yes, I want to just report that the Pride Committee
had, one of our issues had been getting up the American flags and
the banners around especially the Lake, and other parts of Mount
Olive. We found a company that we entered into a contract with
last year. The contract is getting ready to finalize for this year
and they were a little bit upset with some of the additional costs
and all of a sudden we’ve been charged so we’re going
to be looking for a new company. Mr. Quinn is working with us on
that. Otherwise, everything else is going great.

Lake/Environment Issues Committee
President Rattner: The Lake Committee this past weekend had its
second semi annual cleanup. There’s going to have to be some
follow up because it was a windy, drizzly day. So it was very slippery
and it was unsafe to go down to a lot of areas close to the water.
I did find, which I’ll be passing on to the Administration,
a place that looks like a great drinking place because I filled
up two garbage pails of just the bottles that I found there.

COUNCIL COMMENTS
Mrs. Labow: Oh, good, thank you. I just want to say that I received
a message from Liz Ouimet who is one of our newest Board of Education
members, and she wanted to let me know that the Board of Education
is having their Energy Audit. They approved it. One of the other
programs that Liz wanted to have at the High School was for CCM
to have a table to talk about the programs that they have where
the kids can get credits ahead of time for college. Unfortunately,
the night that we had Back to School night, I think it’s
next week at the High School, they didn’t have any representatives.
Liz took it upon herself to man that table to give out the information
to the parents about the college credits kids can get early. So,
I just want to say thank you to Liz because I think that’s
above and beyond and it’s wonderful that she’s doing
all that.
Mr. Greenbaum: Back to School night is tomorrow night at the High
School.
Mrs. Labow: Is it tomorrow night? Okay, I wasn’t sure if
it was tomorrow night or next week. Good, thank you. So everyone
should visit the CCM table manned by Liz Ouimet to get the good
information.
President Rattner: Is that all?
Mrs. Labow: That’s it.

Mr. Perkins: It’s hard when you go the opposite way, isn’t

Mr. Roman: I would like to end nuclear proliferation and have
international dialogue open. So could somebody nominate me for
the Nobel Peace Prize?
Mrs. Labow: I nominate Alex Roman for the Nobel Peace Prize.

President Rattner: Mr. Perkins?
Mrs. Labow: You’re out of luck.
Mr. Perkins: Thank you, Mr. President. Just a little follow up
on Mrs. Labow’s statement. Mrs. Ouimet and myself have been
corresponding over the past couple of months. I was able to steer
her, she’s a very energetic young lady, I was able to steer
her toward the Clean Energy Program that the State administers.
They did approve to go forward to start soliciting for a municipal
audit and are also going to be meeting with her in the next couple
of weeks, and we will look at some other things such as paper performance
and other programs that are available for the School, and we may
be able to partner up with them, as well as some renewables.
Mrs. Labow: I told her you were the one to call.
Mr. Perkins: Yes, and she said that.
President Rattner: Thank you, Mr. Perkins.
Mr. Perkins: So we are moving together on some more shared revenue,
my friend.
