It was very touching to be at the Vietnam War Memorial and to see all of the Vets there partaking in the activities, and remembering those who had fallen for protecting our way of life. Questions on Bill List?

President Greenbaum: We’re out of executive session and we’re back into our Township Council Special Public Meeting. The next item on the Agenda are questions on the Bill List for this evening. Has everyone had an opportunity to review the Bill List and get questions to the Administration? Okay, Mr. Russell, did you have anything this evening on the Bill List? Okay, why don’t you raise them so that Sherry can have an opportunity to… Ned, I don’t know if you have anything also? Then let’s start with Mr. Russell. Just identify the question so that if possible, Sherry can get you the answers before the end of the meeting.

Nelson Russell, Budd Lake: On page six, these are just questions, $14,000 transfer fourth quarter interest Mount Olive Township. We’re transferring the interest from…?

Ms. Jenkins: We’re transferring the interest that, our portion of the interest that’s earned on the Developer Escrow Accounts over to our operating budget.

Mr. Russell: Okay, the Developer doesn’t get any of that interest, right?

Ms. Jenkins: The developer gets two-thirds and we are able to keep a third.

Mr. Russell: Okay, on page 16 I see three charges of $13.20 for fire hydrant rental. Why are we renting fire hydrants?

President Greenbaum: Mr. Perkins, you can answer that, correct?

Mr. Perkins: Of course I can.

President Greenbaum: Go ahead, give Mr. Russell the answer to it.

Mr. Perkins: Mr. Russell, the private utilities that run and have franchises, Hackettstown, American Water, have in their approved tariffs public fire hydrant rental fees. The municipalities are charged that fee and that is also that fee as well as rates that are paid by the average rate payer through those systems become what’s turned back at the end of the year in gross receipts and franchise taxes. So there is a fee that is accepted. We literally rent public fire hydrants.

Mr. Russell: Okay, and these are paid out of our general fund.

Mr. Perkins: Yes they are.

Mr. Russell: So people who don’t have fire hydrants are still paying for fire hydrants.

Mr. Perkins: Yes you are.

Mr. Perkins: The theory being…

Mr. Russell: Is there some way around renting fire hydrants?

Mr. Perkins: Excuse me?

Mr. Russell: Is there some way around renting fire hydrants to pay for the water as it’s used?

Mr. Perkins: The only way that they could do that, Nelson, is if they actually put water meters on every single fire hydrant. Then in the event of a fire then they would hook up and you would know exactly how much water you would use, and then they would have to have a tariff proof rate to be able to charge for that.

Mr. Russell: Okay.

Mr. Perkins: So all of our tankers that are out right now that fill up, if they fill up off that public hydrant to fight a fire at your house or mine because we don’t have public water supply, that’s part of the benefit. So it’s an overall benefit to the Township right now.

Mr. Russell: Okay.

Mr. Perkins: If the entire Township, let’s say, were to be sold off and all of our systems were to become private, then one could argue that yes, those private fire hydrant charges could be assessed directly to those people there. There was something in 1992 I believe it was, it was called the Kelly Law which private utilities had to go together with the municipality to have the municipality accept the public fire hydrant charge. So that’s kind of where we’re stuck with it.

President Greenbaum: I suggest that if you really have an interest though, you can discuss this at length with Mr. Perkins who seems to have an expertise with respect to…

Mr. Russell: He seems well informed on the topic.

President Greenbaum: Yes he is.

Mr. Perkins: It’s not something I’m happy about, Nelson. I can tell you that though.

Mr. Russell: Well then I will skip ahead to one other related item. On page 38 we’ve got some de minimis charges for food while flushing hydrants. Why are we buying food for the hydrant flushers?

President Greenbaum: Sherry, do you know the answer to that?

Ms. Jenkins: Tim’s coming up.

President Greenbaum: Okay.

Mr. Russell: I know we do it for snow plowers.

President Greenbaum: Was it done on weekends?

Tim Quinn, DPW Director: We flush hydrants twice a year and we do it in the overnight hours to cause less disruption to the residential properties that are on the Township water.

Mr. Russell: Okay, so this is in addition to their normal lunch hour, that type of thing?

Mr. Quinn: Yes, this would be that they work their daily hours and then they would work through the night to flush out the hydrants. So on the overtime basis they are entitled to food through the Township.

Mr. Russell: Okay, thank you.

President Greenbaum: Thank you.

Mr. Russell: And one last question, on page 27 I’m seeing $113,000 and change for a Crown Victoria. I’m assuming that’s more than one. Those are Police vehicles?

Ms. Jenkins: Yes.

President Greenbaum: It’s really nicely equipped though. The Mayor’s driving it.

Mr. Rattner: If it was Parsippany you wouldn’t be laughing.

Mayor Scapicchio: Unmarked.

President Greenbaum: Ned, did you have… By the way, as Ned’s coming up we do appreciate, at least I appreciate the effort that both you and Ned put in in terms of going through the Bill List. An extra set of eyes going through the Bill List is always extremely helpful. I really sincerely mean that, that I appreciate the fact that you question charges that may have slipped by us or that we understand, or have seen so many times that we don’t even question them anymore.

Mr. McDonnell: Thank you. Nelson raised one question I had, sort of. I’ve only got one other item, on page 10 the second item down, airfare for roundtrip ticket. I just wondered what that is all about.

Ms. Jenkins: I will look that up for you. I know it was something that the Police attended but I’ll check the P.O. for you.

Mr. McDonnell: Okay, the reason I was curious, I was wondering why we would be sending someone out of state for something. I assume it’s out of state.

Mr. Rattner: Since I see people here tonight wondering what happened, I think the change, the substantial change was that we added a line, “except for local delivery.” I believe that’s true. That was the result of some of the comments not just here but e-mails that we receive. What happens if our gardener comes? What happens Mr. Rattner (cont’d): if UPS, or we’re getting a delivery of something, if it says no stopping, no standing or anything else. So, it’s considered a substantial change when we say, “except for local delivery.” That’s why it’s being put off because now we have to give people an opportunity to see the revised wording.

PUBLIC PORTION

President Greenbaum: At this point I’ll open it up to the public to anyone who wishes to be heard on any particular issue. This is one of two opportunities in the meeting. There will be a separate opportunity during the public portion in the Workshop. Yes, ma’am.

Laura Szwack, 7 Theresa Drive: I’ve just been reading in the paper about all of the things going on. This is not about Open Space. This is about Theresa Drive. My husband and I didn’t sign the petition. The students don’t bother us. We have a student in the High School, but I’m not going to stand in the way of this petition. If my neighbors feel that upset about the students then I’m not going to stand in the way. I did want to stand up for the students because I just never experienced any of the problems that they have. Now, I’m not there in the afternoon when the students get out, but I’m right in the middle of them in the morning when they’re very surly because it’s 7:00 in the morning. I have a student at the High School and I’m taking her on my way to work. I just wanted to say, you know, stand up for the High School students a little bit. I’m sorry they don’t have a place to park. I’m not sure that it’s appropriate on Theresa Drive, but I do have one comment and one request that, I really hate seeing these signs in neighborhoods. I think that they are really unfriendly, and it just really drives me crazy. You have eight other yards to put that sign in and I really request that it not be in mine. Then one comment is that I’m sorry that we’re all both not tolerant for each other. The students not tolerant of the people in the neighborhood, and the adults in the neighborhood not being tolerant or helpful with the students. I just had to say that because we’ve been silent on the whole issue. We didn’t want to go against our neighbors if they felt this bad and took this much effort to go through, they must be under duress, but we haven’t experienced personally. Thank you.

President Greenbaum: It’s something that can be discussed with Mr. Quinn. I imagine that the requirements of law, in terms of posting per violations, is fairly specific as to what you need to do. So if you can run that by and it’s acceptable to everybody and it works as a matter of law, so be it. Okay, any Council Comments this evening before we adjourn into our Workshop Meeting. COUNCIL COMMENTS

Mr. Rattner: While you were in Washington seeing the real big Veterans ceremony, we had our own here at a brand new location thanks to Mr. Perkins who was able to put it together in a matter of hours after the monument was changed. We had a perfect day and a clear sky. It wasn’t even windy. So we have one here that was a very dignified ceremony.

President Greenbaum: Great. Mr. Perkins?

Mr. Perkins: Yes, Mr. President, thank you Steve. You kind of beat me to that. In honor of the Veterans Memorial being moved up to Turkey Brook which took place just about a week prior, we held a small, very brief ceremony on Veterans Day kind of just to welcome the Memorial there. Councilman Rattner showed up in his stars and stripes tie which is always appropriate. It was a nice ceremony. Hopefully when that is complete, it will be a wonderful place for people to come and reflect and think about some of your family members, and think about present members that are over fighting for our freedoms right now. Also, on a personal note, the Kiwanis Breakfast with Santa is this Sunday at the Budd Lake Fire house, and the Santa House officially opens at 1:00 in the afternoon at George’s Liquors. So please bring your nephews, nieces, grandchildren, pets, significant others and come enjoy a few minutes with Santa. Thank you, Mr. President.

Motion was made and seconded, all in favor and none opposed, the Public Meeting was reconvened at 8:18 pm.

President Greenbaum: This is for:

Ord. #48-2007 An Ordinance of the Township of Mount Olive to Amend Chapter 106, “Dogs and Other Animals” of the Code of the Township of Mount Olive.

President Greenbaum: Specifically Section 1 is going to be modified to read as follows, “Chapter 106-7, “Fees”, of the Code of the Township of Mount Olive is hereby amended to provide that the cost of a license and registration tag shall be increased from $8.00 to $11.00 for spayed or neutered dogs and $11.00 to $14.00 for unspayed or unneutered dogs and the delinquent fee for dogs registered after February 1st of each year shall be increased from $2.00 to $3.00.” What else are we changing, or is that it?

Mrs. Lashway: That’s it.

President Greenbaum: That is the modification.

Mr. Dorsey: Here’s what we want. We want a motion to introduce on first reading Ord. #48-2007 as amended…

President Greenbaum: We haven’t amended it yet. We need the motion to amend. Do we not?

Mr. Dorsey: Fine.

President Greenbaum: Well, actually Mr. Rattner moved it. Mr. Rattner, will you accept the amendment?

Mr. Rattner: That’s why I went right to the next one because I knew it wasn’t right.

President Greenbaum: Yes, very good. You and Colleen are better… Colleen already seconded it.

Mrs. Labow: Second.

President Greenbaum: Mr. Buell, do you accept the amendment?

Mr. Buell: I accept it.

President Greenbaum: Okay, are there any Council Comments with respect to the amendment on first reading? Seeing none, Roll Call as amended.
