TOWNSHIP COUNCIL PUBLIC MEETING MINUTES
- FEBRUARY 16, 2010
The Public Meeting of the Mount Olive Township Council was called
to Order at 8:27 pm by President Tobey: We will begin with the
Open Publics Meeting Announcement as the Pledge of Allegiance and
moment of reflection was earlier.
OPEN PUBLIC MEETINGS ACT ANNOUNCEMENT
According to the Open Public Meetings Act, adequate notice of this
meeting has been given to the Mount Olive Chronicle. Notice has
been posted at the Municipal Building, 204 Flanders-Drakestown
Road, Mount Olive Township, New Jersey and notices were sent
to those requesting the same.

PROCLAMATION OF THE MAYOR –
President Tobey: Mayor at this time I believe you have two proclamations.
Mayor Scapicchio: I do. The first one is honoring the 100th anniversary
of scouting.
Office of the Mayor – PROCLAMATION- Honoring The 100th Anniversary
of Scouting
WHEREAS, the success of Scouting for Cub Scouts, Boy Scouts, Explorers
and Venturing depends on our community organizations; and
WHEREAS, there are 505 churches and synagogues, schools and parent-teacher
associations, service and fraternal clubs and other community organizations
that have been chartered organizations are performing outstanding service for
18,871 boys and young men and women; and
WHEREAS, the Patriot’s Path Council of the Boy Scouts of America and
its corps of dedicated volunteer leaders are providing necessary support to
the leaders in the 6,236 Cub Scout Packs, Boy Scout Troops, Explorer Posts
and Venture Crews.
NOW THEREFORE, be it proclaimed that I, David M. Scapicchio, Mayor of Mount
Olive Township do hereby proclaim, February 14-20, 2010 as Scouting Anniversary
Week and urge our citizens to join with me in expressing appreciation to the
community organizations and their volunteer Scouting leaders for bringing this
values-based program to our young people.

Dating Violence and Prevention Month
WHEREAS, the success of Scouting for Cub Scouts, Boy Scouts, Explorers
and Venturing depends on our community organizations; and
WHEREAS, there are 505 churches and synagogues, schools and parent-teacher
associations, service and fraternal clubs and other community organizations
that have been chartered organizations are performing outstanding service for
18,871 boys and young men and women; and
WHEREAS, the Patriot’s Path Council of the Boy Scouts of America and
its corps of dedicated volunteer leaders are providing necessary support to

Resolutions on the Consent Agenda List are considered to be routine
and non-controversial by the Township Council and will be approved
by one motion (one vote). There will be no separate discussion
or debate on each of these resolutions except for the possibility
of brief clarifying statements that may be offered. If one or more
Council member requests, any individual resolution on the Consent

57904 McManimon & Scotland, LLC, it says professional services.
What is that for?
Mr. Greenbaum: Bond Counsel.
Mr. Fleischner: Bond Counsel. My question is also on 57917. It
was $1,890.00 paid to Rutgers for Managing and Developing Management
Tasks, Public Relations. What conferences were these?
Mrs. Maniscalco: These are actually courses that one of our employees
is taking at Rutgers. Okay?
Mr. Fleischner: Okay, thank you.
President Tobey: Thank you. Does anyone else from the public?

Can you explain what that might be?
Mrs. Maniscalco: In order to show movies at the Senior Center
we have to pay an annual licensing fee. That is what that is for.
Mr. McConnell: Okay thank you.
President Tobey: Thank you. Anyone else from the public? Does

President Tobey: Thank you. Any Old Business? Any New Business?
Mrs. Labow.
Mrs. Labow: Lisa sent an email out to us today that the petition
had been submitted for the ballot initiative for the EMS issue
and I suspect that it is going to, the certification will come
up at the next Council meeting. The last time we have the EMS issue,
we had people in the hallways and outside and everything else.
Are we going to change the venue so we can have…
Mrs. Lashway: I am not promising in two weeks. I’m by myself
on this petition so I’m not promising…I am going to
have to use as much time.
Mrs. Labow: When it comes about, are we going to…
President Tobey: It’s been presented so the next step in
that, I mean if it was presented today, are you saying that there
should have been a large turnout tonight, I’m not certain.
Mrs. Labow: No, no…
Mrs. Lashway: Once the ordinance is…if the petition is certified,
it then has to come back to Council and the Council either approves
the ordinance and puts it on for second reading, because it is
already deemed that first reading has been had, or you do nothing
and it goes to a Special Election.
Mr. Perkins: Excuse me, we have the third option of adopting something
that is substantially the same.
Mrs. Lashway: Just like we did with TNR.
Mr. Perkins:
President Tobey: Thank you.
Mrs. Labow: So my question is, are we…
Mr. Greenbaum: That is a question which you will have to address
with Mr. Tobey at some point in the future when he knows the exact
date and you can you can suggest to him, I guess, at that point
that you think that there is going to be a large turnout and it
might be in the best interest of the community to have it at some
other location. That is what you are suggesting. I think Mr. Tobey
and Ms. Lashway are saying at this point that they are not sure
exactly when it is going to be on for.
Mrs. Labow: That brings us to my next question. Since it Lisa
has 20 days, is it business days or days? Is it 20 days period
for your certification?
Mrs. Lashway: I don’t know off the top of my head.
Mrs. Labow: So if it’s 20 days, our next meeting is two
weeks from now. Fourteen days…
Mrs. Lashway: It is not going to be in two weeks. I can promise
that.
Mrs. Labow: I understand that. My next question would be, will
we have to have a Special Meeting?
Mrs. Lashway: The Statute reads, it is the next Council meeting
after it is certified. It doesn’t make provision to have
a Special Meeting.
Mrs. Labow: That is all I am asking because I just wasn’t
sure.
Mr. Greenbaum: I would imagine that it is going to require some
legal review by Mr. Dorsey’s office to first find out whether
it is an appropriate ordinance, ballot initiative, whatever was
submitted. I haven’t seen it. I don’t know the answer
to the question and even if I had seen it, I wouldn’t know
the answer to the question.
Mrs. Labow: Suffice it to say that when it gets to a point where
it is going to be on the Agenda for the public, I strongly suggest
that we have it at a larger venue because I don’t know how
many other people had residents voice concerns that the public
meeting should be in a venue large enough to hold…
President Tobey: We will take that into consideration. Thank you.

PUBLIC PORTION
Joe Fleischner, Karen Pl., Budd Lake: There really wasn’t
anything good on TV tonight, that’s why you have to put up
with me. I apologize. First, I would like to commend the Mayor
for allowing the Town Council meetings, even though it hasn’t
worked out yet, to be recorded on video. What I do find ironic
is that the School Board refuses to record their meetings on video
which I find quite interesting. The second thing I would like to
comment on is I know, I read in the paper, I did not speak to anyone
firsthand about Combe Fill North being turned in to a methane generation
plant. When this actually was discussed by the Environmental Commission
a number of years ago and I agree wholeheartedly. I think that
would be an outstanding use. One of the things that concerns me
is, we all read in the newspaper lately, I guess it was a couple
of weeks ago when the natural gas plant that was under construction
had an explosion and unfortunately people lost their lives and
numerous people were injured. What I did find interesting was though,
of the ambulances that responded and the first aiders that responded
to dig deep in to the, again it is the internet so one never knows,
but apparently most of the responders were all volunteers, first
responder volunteers, etc., that came to the aid of those individuals
and I think we need to keep that in mind considering what we are
currently discussing within this township. It is just a point that
I wished to make.
President Tobey: Thank you. Mr. McDonnell?
Ned McDonnell, Budd Lake: Just a question or comment about the,
actually it was the meeting where there was a huge turnout and
many people could not get into the area to make public comment.
Does State law require that if the public can’t access to
the room, that the meeting is either cancelled or must reconvened
in a larger venue.
Mr. Horan: No.
Mr. McDonnell: So if you can’t get in the room, you are
just out of luck. Is that…
Mr. Horan: The Council is free to choose whatever venue they want
to hold the meeting. They just have to comply with the notice provisions
for that meeting.
Mr. McDonnell: Okay. Thank you.
President Tobey: Thank you. Anyone else from the public?
Alex Cranmer, David Pl., Flanders: I just had a thought and maybe,
I haven’t done my homework on it but I just figured maybe
somebody here has the answer. Would it help at all in the discussion
of volunteer ambulance squads to look at the legality and feasibility
including cost effectiveness of merging the Budd Lake First Aid
Squad and the Flanders Squad into Mount Olive Volunteer First Aid
Squad but keep each unit, Budd Lake and Flanders. Would that save
any money and who would have the answer to that? That was it.
Mayor Scapicchio: Flanders Fire and Flanders EMS are already one
unit and there is a cost savings there. I think if that was to
occur, the natural fit would be for Budd Lake Fire and Budd Lake
EMS to get together. That would be the natural thing.
Mr. Cranmer: Not Budd Lake and Flanders?
Mayor Scapicchio: No, two separate organizations, actually it
is three separate organizations.
Mr. Cranmer: Organizations all over the country merge to save
money. It’s possible.
Mayor Scapicchio: I guess we could look at that in the overall
picture, sure.
President Tobey: Mrs. Labow?
Mrs. Labow: A little further answer on that question, sir, I know
that during some of our budget discussions of previous years, in
terms of ordering supplies, they do get together and buy in bulk
to save money. So that came through, the Safety Committee meetings
that they had in previous years so they already save funds in that
direction by not directly being merged but purchasing together
as I understand it. I’m getting a nod back there, is that
correct? Yes, to a degree, where they can actually is what I was
told.
